OptimThese terms apply between you and CyberBuild Solutions S.R.L. (VAT RO53532866, registered office at Str. Ioan Stănei nr. 42, Corbu, Constanța County, Romania), which builds and operates the Optim app and the dontsitgetfit.me website. By creating an account, you accept them. 1. What Optim is
Optim is a web app for keeping a meal log: you record what you eat, and the app calculates calories and macronutrients, a daily target and recommendations for your next meals. Optionally, it can read data from your Garmin account and can also be used over WhatsApp. The app's interface is currently in Romanian.
The app is in private beta: accounts are created by invitation only and it is free for the duration of the beta. If we ever introduce a paid version, we will tell you well in advance, and nothing will be charged without your explicit agreement.
2. Not a medical service
Optim's recommendations are informational and based on general calculations (energy needs, macronutrients). They are not a diagnosis, treatment or medical advice and do not replace a doctor, dietitian or nutritionist. If you have a medical condition, are pregnant, take medication or are preparing for a procedure, talk to your doctor before changing your diet. Optim is not suitable for eating disorders; if you are struggling with one, please seek help from a specialist.
3. Your account
- You must be at least 18 years old.
- An account is for one person only. Don't share it, and keep your password to yourself.
- Your profile data (age, weight, height) must be accurate, otherwise the calculations are meaningless.
- You can delete your account at any time, from the app. See Data deletion.
4. What you may not do
- try to access other users' accounts or data;
- upload content that is illegal, offensive or unrelated to your own food;
- use the app in an automated way (bots, scraping) or try to get around its security limits.
We may suspend an account that breaks these rules. We will tell you, and tell you why, except where the law does not allow it.
5. Garmin and WhatsApp
Connecting a Garmin watch uses access to your Garmin account. Garmin may limit or stop this at any time, in which case the app carries on with your profile data. Use of WhatsApp is also subject to the WhatsApp terms. On WhatsApp you write first; the word HUMAN (or OM) puts you in touch with a person on our team, and STOP ends all messages.
6. Availability
We do our best to keep the app working well, but as a beta it may have interruptions, errors or changes to features. We may end the beta; if so, we will tell you at least 30 days in advance and give you the chance to download your data.
7. Liability
To the extent permitted by law, we are not liable for decisions made solely on the basis of the app's recommendations, for incorrect food or portion estimates you did not correct, or for interruptions of the Garmin or WhatsApp services. Nothing in these terms limits your statutory rights as a consumer.
8. Intellectual property
The app, its code, texts and design belong to CyberBuild Solutions. Your data remains yours; you only give us the right to process it in order to provide the service, as described in the Privacy policy.
9. Changes, governing law, disputes
If we change these terms, we will tell you in the app at least 15 days in advance. If you do not agree, you can delete your account. Romanian law applies. We try to resolve any complaint directly, at iulian@cyberbuildsolutions.com. As a consumer, you may also contact the Romanian National Authority for Consumer Protection (anpc.ro) or the European online dispute resolution platform.
